01. INTRODUCTION

Your use of this Website is governed by these terms and conditions. Please take a few minutes to review them. Your use of this site indicates your acceptance of these terms and your agreement to follow and be bound by them. If you do not agree with any of these terms and conditions, do not use this site. These terms and conditions may change. We may periodically change the terms, without notice, so kindly check them from time to time as your continued use of the site signifies your acceptance of any changed terms.

02. ELECTRONIC COMMUNICATION

By using our website or communicating with us through electronic means (such as email) you consent and acknowledge that any and all communication we provide to you shall satisfy the legal requirement that such communication should be in writing.

03. ECOMMERCE & PRIVACY POLICY

The private information we require from you in order to process your order include your personal information, delivery address and telephone numbers. These details will remain in strict confidence with us at all times. We will not sell or make your information known to any third parties. Only the information necessary for shipping will be provided to the courier service we use to deliver your product.

We have taken all reasonable care to secure the credit card processing carried out when we receive payment for goods bought on our website. All Credit Card transactions take place via an internationally approved payment gateway, which uses the strictest form of encryption: Secure Socket Layer 3 (SSL3). No credit card details are made known to us, and no credit card details are stored on our website.

Visit PayFast to see security certificate and privacy policy. We cannot be held responsible for any security breaches on your personal device, and the consequences of such breaches, which may result from a lack of adequate virus protection software or spyware.

04. OUR PRODUCTS

Please note that all elements Ceramics items are unique and handmade  pieces. Each piece is made and glazed by hand adding to its  individual organic quality and character. Sizes, colour, shape and pattern can and may differ from piece to piece. All pieces when glazed are done so using lead free, food-safe glazes unless otherwise stated.

Unglazed pieces or unglazed parts of the pieces sold are sealed with the highest quality commercial food safe nanotechnology. Please see the Elements Air and Elements Earth FAQ’s section for general questions on nanotechnology.

We prohibit the purchase of any products for commercial resale purposes from our online retail shop

05. PRODUCT PRICES & CURRENCY

We may change the price of any of our products at any stage without prior notice. The new product pricing comes into effect immediately.  Prices are subject to change without notice.

Retail Shop:

Unless otherwise stated, shipping is charged in addition to the price of the product. A breakdown of product price and shipping charges appears on our checkout page.

Wholesale Shop:

Please contact Elements Ceramics for wholesale enquiries as we are only making small batches of functional ware and single items at the moment.

06. YOUR ORDER

We reserve the right to refuse any order. This could, for example, result from one of the following:

The product being unavailable from stock, or identification of an error within the product information, such as pricing or promotion. Products in the retail shop are generally ready made. During the order process, and prior to shipment, you will receive an “order confirmation” email from us. This email does not guarantee that your selected product or products are available in stock and neither does it serve as a legally binding obligation to fulfil your order.

Your order represents an offer to purchase, which we only accept when we dispatch your goods for shipment. We signify our acceptance of your offer through an email entitled “shipment concluded” (second email). We reserve the right to cancel your order anytime between receipt of order and shipment, for any reason, whether or not payment has been made.

When payment has been made, you qualify for a full refund. In the unlikely event that your chosen product is not in stock and we cannot fulfil your order, we will contact you as soon as possible. In this case, you may choose to receive a full refund or for store credit to be allocated to your account.

07. PAYMENT OPTIONS

South Africa & African Retail Shoppers:

All credit card transactions take place via  Payfast; an internationally approved payment gateway. Please note that you do not have to have an existing Payfast account to pay via credit card – you can simply make use of the PayFast platform on a once off basis.

Payments may also be be made via Visa or MasterCard credit cards, Snapscan  or by electronic bank transfers (EFT) into our bank account. All details are provided upon checkout.

Should you prefer payment via EFT, complete the checkout and select the EFT checkout option and we’ll be in touch with relevant bank details.

If you have elected to pay via EFT or Snapscan, payment must be made within 24 hours and proof of payment needs to be mailed to accounts@nullelements-ceramics.co.za. Once we have received confirmation from our bank that the money has been transferred to our bank account, the order will be processed.

We reserve the right to cancel your order 24 hours after you have placed it should you not provide adequate proof of payment.

Should you prefer payment via Snapscan, complete the checkout and select the  Snapscan checkout option and we’ll be in touch with the QR code.

International Retail Shoppers:

Please contact us directly should you wish to place an order. We accept payment via credit and cheque cards through secure payment gateway  Payfast  or by electronic bank transfers (EFT) into our bank account. You do not need to have an account to make payment via Payfast. 

08. CANCELLING YOUR ORDER

South Africa & Africa Retail Shoppers:

You may cancel your retail shop order any time prior to shipment, whether or not payment has been made. In the cases where payment has been made, you will be refunded after a reduction of 10% for administration costs (upon total order cost).

If you have elected to pay via electronic funds transfer (EFT) or Snapscan, we reserve the right to cancel your order 24 hours after you have placed it should you not provide adequate proof of payment.

International Retail Shoppers:

You may cancel your retail shop order any time prior to shipment, whether or not payment has been made. In the cases where payment has been made, you will be refunded after a reduction of 15% for administration costs (upon total order cost).

09. SHIPPING

We ship worldwide.

We ship during normal working hours Monday to Friday: not on Saturdays, Sundays and South African public holidays.

We will supply all goods to our delivery company in good order. The onus rests upon them to ensure the goods arrive at your chosen delivery address in the same good order.

Elements Ceramics will strive to provide customers with the lowest international courier costs we can find.

Elements Air ships internationally with NO extra costs for customs duty and import tax. The only extra fee you will pay will be the courier cost.

South Africa Retail Shoppers:

Delivery costs are a flat rate fee. We courier door-to-door. Unless otherwise specified, your shipping cost shall be depicted upon checkout prior to payment and order processing. We can only ship to a street address and not to a PO Box number.

Should no-one be present at the delivery address to sign receipt of delivery (third attempt) your goods will be returned to the shipping agent’s office, and it is your responsibility to collect them. We cannot be held liable for an incorrect shipping address entered into our system.

Once an order is shipped and the “sale concluded” the order is in the hands of courier service. Unfortunately, we cannot be held responsible for delays in delivery times caused by delays on the side of the courier.

All orders are tracked and you will be supplied with a waybill number.

 Shipping  costs are non refundable.

International Retail Shoppers:

We ship via Expedited Mail service to-door. Delivery times are 5-10 working days. If there are any delays at customs delivery time can exceed this.

Delivery costs are calculated by weight. Unless otherwise specified, your shipping cost shall be depicted upon checkout prior to payment and order processing. We can only ship to a street address and not to a PO Box number. A telephone contact number needs to be supplied.

Should no-one be present at the delivery address to sign receipt of delivery (third attempt) your goods will be returned to the shipping agent’s office, and it is your responsibility to collect them. We cannot be held liable for an incorrect shipping address entered into our system.

Once an order is shipped and the “sale concluded” the order is in the hands of courier service. Unfortunately, we cannot be held responsible for delays in delivery times caused by delays on the side of the courier.

All orders are insured and tracked and you will be supplied with a waybill number.

Elements Ceramics is not responsible for any international customs fees, duties or taxes incurred.

Shipping  costs are non refundable.

Elements Ceramics products are  packaged with extra care in bubble wrap, beautifully  gift wrapped, then placed together with air pockets into double walled boxes and labelled fragile.

10. RETURNS AND EXCHANGES

South Africa Retail Shoppers:

In accordance with our returns policy depicted on our site, you may return a product and qualify for a full order refund based upon the following:

You make contact with us within 3 days of receiving your product. The product is not damaged and shows no sign of usage. The product is in original packaging and properly packaged.

Shipping and handling charges are not refundable; including return shipment (unless return is as a result of our error). We accept returns only via door-to-door courier at your cost.

We require full banking details in order to process the refund (not applicable to Payfast purchases) and we will do so within 7 days of the goods reaching our door.

Please note that any product exchanges are treated as a new order and are thus subject to standard delivery times and costs.

If you receive a faulty / incorrect product from us, you qualify for a full order refund, or product replacement at our expense. Your replacement choice is subject to our stock availability.

Kindly note that goods are only classified as  faulty if they are received  faulty in which case you need to supply us with a photograph of the  faulty goods within 3 days of receiving your product.  Cracks classify as faulty.  Items that are damaged during opening and from wear and usage are not considered faulty.

Gift cards and sale items are non-refundable.

International Retail Shoppers:

You may return a product and qualify for a full order refund based upon the following:

You make contact with us within 3 days of receiving your product. If you receive a faulty / incorrect product from us, you qualify for a full order refund, or product replacement. Your replacement choice is subject to our stock availability. Kindly note that goods are only classified as faulty if they are received faulty in which case you need to supply us with a photograph of the faulty goods. Cracked items classify as faulty. Items that are damaged during opening and from wear and usage are not considered faulty. Items damaged during transit are to be covered by shipping insurance and proper procedures need to be adhered to. Receiving a product that differs slightly in colour, size, shape or pattern to what was depicted upon your screen when you placed your order does not warrant the good as faulty.

Shipping and handling charges are not refundable; including return shipment. We accept returns only via door-to-door courier at your cost.

Gift cards and sale items are non-refundable.

11. INTELLECTUAL PROPERTY

Elements Ceramics owns and are the licensees of all content depicted on the Website. This includes, but is not limited to all text, images, videos, logos, trademarks, designs etc.

Customers or any third party may not copy, publish, distribute or use any of this content in any way for any purpose without our prior written consent.

Any product designed or made by Elements Ceramics is the intellectual property of Elements Ceramics.

When a product is made exclusively for a buyer, the said product will always bear the Elements Ceramics label and at most will read “Elements Ceramics for Buyer”. Furthermore, products labelled as such will fall under the Elements Ceramics brand and remain the intellectual property of the Elements Ceramics.

 (WHOLESALE BASICS)

The Elements Ceramics wholesale policy only applies to those who intend to sell our products in bricks & mortar spaces and through any online platforms other than www.elements-ceramics.co.za.

If you are interested in selling Elements Ceramics in your shop, please contact info@nullelements-ceramics.co.za for wholesale prizes.

All Elements Ceramics  Wholesale applications are subject to approval. We reserve the right to ask for information about and approve your intended distribution channel to decline an application for any reason.

Elements Ceramics  must pre-approve the location, including either the physical place or online platform, where Wholesalers intend to sell our products from. Any change in location must be brought to Elements Ceramics’ attention and is subject to re-approval.

We do not permit international franchises of the Elements Ceramics  brand to be established overseas. Wholesalers may not sell Elements Ceramics  products on platforms such as eBay, Amazon or any unapproved e-commerce platforms.

We reserve the right to cancel a wholesaler account for any reason.

All Elements Ceramics  Wholesalers must trade under their own brands.

All Elements Ceramics  products must be sold as they are received, with no alterations made to the product whatsoever.

The Elements Ceramics  branding may not be removed by the wholesaler.

All  Elements Ceramics  products are checked with a lot of love and scrutiny before they leave for their new homes. Wholesalers are, however, encouraged to check their stock once it is received.

Only faulty items (cracked or broken) may be returned and exchanged and this must be done within 3 days from the date of delivery. Please refer to Returns & Exchanges for conditions attached.

Elements Ceramics  is not responsible for returns, refunds or exchanges on faulty goods that have been overlooked and sold by our wholesalers. This must be dealt with directly by the approved wholesaler.

All orders are made to order and are therefore subject to production lead-time which is an estimate. We ship DAP which means ‘delivered at place’, as per global INCOTERMS. Our team will be responsible for getting the goods to your delivery address, but will not be responsible for customs charges, duties or VAT once your cargo reaches your country. Please refer to section 9: Shipping.

Wholesale prices exclude the cost of shipping, which will be calculated uniquely for each order once the order is completed and packaged. At this stage you will be invoiced directly for delivery fees. Online wholesale orders require 100% upfront payment but should you prefer to rather pay an upfront non-refundable deposit, with final payment due once the order is complete, please mail accounts @elements-ceramics.co.za

Wholesale shop:

Products in the wholesale shop are made to order. Although we adhere to order lead times as stated, these lead times are approximate. During the order process, and prior to shipment, you will receive an “order confirmation” email from us. This email does not serve as a legally binding obligation to fulfil your order but to begin your order. Your order represents an offer to purchase, which we only accept when we dispatch your goods for shipment after receiving payment for shipment at which time we signify our acceptance of your offer through an email entitled “shipment concluded” (second email).

We reserve the right to cancel your order anytime between receipt of order and shipment, for any reason, whether or not payment has been made. When payment has been made, you qualify for a full refund or a refund for the order’s shortfall should the order not be complete. In the unlikely event that we cannot start, fulfil your order on time or fulfil your order at all, we will contact you as soon as possible. In this case, you may choose to receive a refund to the amount of your order not fulfilled or for store credit to be allocated to your account.

CANCELLATION OF ORDERS

South Africa & Africa  Wholesale Shoppers:

Should you  cancel your wholesale order any time after placing the order, you will be refunded after a reduction of 55% (non-refundable, non-transferable deposit) and  a portion of the after-deposit  amount at our discretion depending on how far along the order is at the time of cancellation.

If you have elected to pay via electronic funds transfer (EFT) or Snapscan we reserve the right to cancel your order 24 hours after you have placed it should you not provide adequate proof of payment.

International Wholesale Shoppers:

Should you  cancel your wholesale order any time after placing the order, you will be refunded after a reduction of  65% (non-refundable, non-transferable deposit) and a portion of the after-deposit amount at our discretion depending on how far along the order is at the time of cancellation.

If, by agreement you have elected to pay via electronic funds transfer (EFT) we reserve the right to cancel your order 24 hours after you have placed it should you not provide adequate proof of payment.

SHIPPING

Wholesale Shop:

We ship globally.

When placing your wholesale order, your shipping options are stated as free, however we will contact you to arrange shipping once your order is complete and we know the final weight of your order. Should you require an idea on shipping fees to your destination prior to placing an order, please mail us at info@nullelements-ceramics.co.za. Wholesale prices do not include shipping fees.

Should you choose to ship with us, you will be quoted (insurance costs can be  included) and charged for shipping on a separate invoice via email. Delivery costs and times vary and depend upon weight and final shipping destination.

Your order  will be stored at no expense at the Elements Ceramics studio for up to  7 calendar days after the invoice for balance of payment has been issued. If payment is not received within 7 calendar days of the final invoice being issued, a daily storage rate of the equivalent of ZAR100 will be charged thereafter for up to a further 23 calendar days.

Should any final payment still not be made within this  30 day calendar period Elements Ceramics has the right to resell the order and the order deposit will be forfeited. Should you organise your own shipping, this also applies should your order not be collected after 7 – 30 calendar days once notification of order completion has been issued.

Once shipping fees are paid for by you, your order will then be shipped to you and your “shipment concluded”. Goods will only be released for shipment once final payment has been made and payment reflects in our bank account.
